A Deloitte Private Connect services subscription is provided subject to the below roles and responsibilities. It is your responsibility to read and retain this information. Deloitte will accept no liability for any loss or damage you may incur as a result of not using and accessing your Deloitte Private Connect account and integrated applications in accordance with the roles and responsibilities set out in this document. Deloitte may update this document from time to time.
The information set out in this document with respect to use, access, login details, password security, privacy, intellectual property and data applies to Deloitte Private Connect and to the third party applications referred to in this document.
By registering to use Deloitte Private Connect you acknowledge that you have read and understood these roles and responsibilities and that you have the authority to act on behalf of any person for whom you are using or accessing Deloitte Private Connect. You are deemed to have agreed to abide by the roles and responsibilities on behalf of any entity for which you use Deloitte Private Connect.
The primary account holder for Deloitte Private Connect will be required to set up their account with a unique log in and password to activate their service. It is the responsibility of the primary account holder to ensure their log in and password is kept safe and not disclosed to others.
If you wish to add additional users to your Deloitte Private Connect account, you must authorise Deloitte to provide that person with access. As part of the authorisation process, you will provide the name and email address of other proposed users. As a user, your email address must be unique and be reasonably identifiable as relating to you. If the email address is not reasonably identifiable, Deloitte will contact you by phone, confirm that they are speaking to the correct individual and ask for confirmation of your email address. Once verified, Deloitte will set up your access and communicate the unique log in and password to you as a new user via your email address.
It is your responsibility to ensure that your unique log in and password are kept safe and not disclosed to others. Each user must have a unique email address as each login may only be used by one individual. However, you may create separate logins for other users to have access to your Deloitte Private Connect account. Deloitte will assume that all access to and use of your Deloitte Private Connect account, using a particular login and password is being done by the relevant user.
It is your responsibility to regularly review your Deloitte Private Connect account in order to stay aware of other users who may have been given access to the account.
If you are removed as a user from your Deloitte Private Connect account without your prior knowledge, you should assess whether there is any of your Personal Information (as that term is defined in the Privacy Act 1988 (Cth)) stored on your Deloitte Private Connect account. If so, please contact your Deloitte Private advisor immediately.
Your use of your Deloitte Private Connect account, including any additional functionality does not transfer to you any Deloitte or third party intellectual property rights, and all right, title and interest in and to such rights will remain (as between you and Deloitte) solely with Deloitte.
Intellectual Property Rights
Deloitte Private Connect and all apps contained therein are protected by copyright, trademark, trade secret and other intellectual property rights. All such rights are reserved. You may not reproduce, publish, copy, or reuse any portion of Deloitte Private Connect or application code, or visual design elements or concepts included in Deloitte Private Connect or the apps without express written consent from Deloitte. You must not modify, copy, adapt, reproduce, disassemble, decompile or reverse engineer any part of Deloitte Private Connect.
You are responsible for maintaining copies of all of your data input into your Deloitte Private Connect account. Deloitte adheres to appropriate professional practice and procedures to minimalise the risk of data loss, including a daily system back-up regime for any data stored on Deloitte’s systems, but does not make any guarantees that there will be no loss of data. Deloitte expressly excludes, any liability for any loss of data, no matter how caused. It is your responsibility to ensure that you do not violate any applicable law, including the Privacy Act 1988 (Cth), as amended, in your use of Deloitte Private Connect and to respect the legal protection of materials accessible by Deloitte Private Connect as well as the privacy of your personnel and other users of your Deloitte Private Connect account.
You are responsible for providing and maintaining all equipment and software browsers necessary to establish a connection to the internet. You must pay any fees and charges for the telephone and Internet Service Provider services associated with access to your Deloitte Private Connect account. You are responsible for maintaining your own industry-standard anti-virus and firewall products and other security measures to protect the security of your computer hardware and software. Deloitte is not responsible for the operation of any secure electronic system (other than our own systems), and any other electronic system or ancillary equipment when you use Deloitte Private Connect.
You are responsible for the accuracy, completeness and currency of any data input into your applications and you acknowledge and agree that Deloitte is not responsible for any inaccuracy in the information displayed which occurs as a result of incorrect data being input by you.
You acknowledge and agree that the display of your information is a visualisation of your information and there may be other means of displaying and/or interpreting your information. You are responsible for any business decisions that you make as a result of your interpretation of the information displayed.
Transact terms and conditions
Transact is accessed via Deloitte Private Connect and provides integration with your cloud-based accounting app.
The process and user responsibilities for logging into Transact are the same as set out above, except that in the event that you wish to include additional users, you will need to contact your Deloitte Private Connect Adviser or Support and we will assist you with this.
Please note that your unique login and password allows you to digitally approve your income tax return and is the identifier by which Deloitte confirms that it is you who has agreed to such approval. It is your responsibility to keep your unique login and password safe and not to disclose to any third parties.
As noted above, you should regularly monitor who has been given access to your Deloitte Private Connect account, assess your position if circumstances change and inform Deloitte immediately if you no longer wish to have your personal information accessible in Transact. In addition you should inform Deloitte if you do not wish to have access to Transact and your Deloitte Private Connect account.
It is your obligation to manage the documentation that you choose to upload to Transact. Where any information is uploaded to Transact by you or a third party, you are responsible for ensuring that the information is accurate, current and complete.
Users of Transact acknowledge and agree that they will use Transact in accordance with the Privacy Act 1988 (Cth) and any other relevant privacy legislation) and in a manner that is not contrary to the below Document Handling Guide. Deloitte will accept no liability for any loss or damage incurred as a result of not accessing or using Transact in accordance with the Document Handling Guide and the Privacy Act 1988 (Cth).
Deloitte may modify or discontinue Transact (in whole or in part) at any time and Deloitte is not liable to you or any third party for any modification, suspension or discontinuance of Transact.
Connect Document Handling Guide
To ensure privacy and confidentiality is maintained only documents relating to your engagement with Deloitte should be uploaded onto the Connect Transact app. This may include documentation required to support the financial transactions in your accounts and/or the preparation of your year-end accounts and income tax return(s), as well as documents of a more permanent nature.
As a general rule, any supporting documentation provided by you will be downloaded onto the Deloitte network and be retained for substantiation purposes for the requisite period required by law. It is recommended that you periodically review documents in ‘Files to upload’ and remove those that are no longer required to help you manage the volume of documents that are likely to accumulate over time.
It is also recommended that you periodically review all your documents located in your Deloitte Private Connect account to assess whether you continue to wish them to be accessible by other users of your account, in particular if your circumstances or those of other users change.
Permanent documents, defined as documents of continuing importance which will be required for longer than the term of the current year engagement, should be uploaded to ‘Documents to keep’. Documents in the ‘Documents to keep’ will not be deleted from Transact, unless otherwise deemed required in accordance with our record keeping requirements, as they are to be maintained there for ease of access and for your future reference.
Although not definitive, below is a list of documents considered permanent in nature:

● Partnership/Sales Agreements
● Engagement Letters
● Lease Agreements
● Organisation Group Structure
● Trust Deeds
● Contracts of Purchase/Sale
● Registrations and Elections eg ABN, TFN, GST, FBT
● Power of Attorney
It is your obligation to manage the documentation that you choose to upload to the Connect Transact app.
By using the Connect Transact app you acknowledge that you agree to use Transact in accordance with these guidelines and the Privacy Act 1988 (Cth) and any other relevant privacy legislation.
Analyser is accessed via Deloitte Private Connect and provides reporting and analytics on unaudited financial information available from your integrated online accounting application. No opinion is made expressly or implied with respect to the accuracy or currency of the report or analysis prepared using the Analyser application.
The analysis and reports are prepared solely for your confidential use and must not be recited or referred to in whole or in part in any other document. The analysis and report must not be made available, copied or recited to any other party without Deloitte’s express written permission.
You acknowledge and agree that the display of your information by Analyser is a visualisation of your information and there may be other means of displaying and/or interpreting your information. You are responsible for any business decisions that you make as a result of your interpretation of the information displayed in Analyser.
Your use of Analyser is governed by the terms set out at www.fathomhq.com/aboutus/terms.
Analyser may, at any time, or from time to time use your data to derive non-personally-identifying and non-company identifying, information in aggregate form. By using Analyser, you consent to such use of your data by Analyser.
Deloitte may modify or discontinue Analyser (in whole or in part) with prior reasonable notice to you and Deloitte is not liable to you or any third party for any modification, suspension or discontinuance of Analyser.
